The forms will be completed with the help of SimplyTraWELL but the decision-making of an application rests solely and exclusively with the Embassy. SimplyTraWELL has no control over the decision of the Embassy.

The Embassy reserves the sole right to grant or deny an application without assigning reasons and the decision of the Embassy is final and binding upon the customer.

SimplyTraWELL will have no liability towards the customer and/or the applicant for:

• Last-minute travel requests that do not leave enough time for the services to be performed;
• The lack of availability of Visa Appointments;
• The lack of availability of Visa appointment time slots with the relevant government;
• The processing time of the Embassy or relevant government;
• The rejection or return of the application (using the relevant Forms) by the Embassy;
• A last minute change in the requirements or process for applying for the relevant visa from the embassies or VACs.

Subject to Applicable Law, SimplyTraWELL shall facilitate coordination with third parties who hold specific contracts with the EDEs in the Specified Countries. Such services are the “Visa Coordination Services”.

The “Specified Countries” are as follows and as SimplyTraWELL and the Customer mutually agree in writing to update from time to time:

• United States of America applies to this customer and as agreed with them.

In relation to the Visa Coordination Services, it is clarified and agreed that the role of SimplyTraWELL is limited solely to coordination with EDE and the [actual services] will be provided by the relevant EDE. SimplyTraWELL shall have no role, responsibility or liability of any kind in relation to any provision, omission, or failings of said services.

SimplyTraWELL is not responsible for monitoring the service parameters and evaluation parameters for the services provided by the EDEs. SimplyTraWELL is an independent service provider and is responsible to the Customer only for its Services to Customer.

In providing the Visa Coordination Services, SimplyTraWELL acts only as a passthrough agent for the purposes of collection and payment of the Visa Fees and EDE Fees to the EDE on behalf of the Customer. SimplyTraWELL is not responsible for the payment of such Visa Fees or EDE Fees and only makes payment of the same on behalf of the Customer once first received from the Customer.

It is the Applicant’s responsibility to attend the Visa Appointment on the date and time notified to the Applicant. If the Applicant fails to attend for any reason, or the appointment is cancelled, SimplyTraWELL may, at the Applicant’s request, book a further Visa Appointment, subject to payment of the additional fees as set out below.

The Third Party Dependencies include:

• The availability of Visa Appointments;
• Processing the Visa application and the relevant processing time taken;
• Changes, without prior notice, on terms, conditions and fees from embassies, consulates, ministries, EDE and other parties;
• Providing the details to SimplyTraWELL of the application criteria and the Visa application process. Accuracy of the information provided, communicated or displayed by the embassies, consulates, ministries, EDE and other parties.
